Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the FieldWyre platform, website, and services (collectively, the “Service”) provided by FieldWyre, a product of Marcia’s Munchies LLC (“FieldWyre,” “we,” “our,” or “us”). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Service.

2. Eligibility

You must be at least 18 years of age and authorized to enter into a binding contract on behalf of yourself or the entity you represent to use the Service.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@fieldwyre.com if you suspect unauthorized use.

4. Subscription and Billing

The Service is provided on a subscription basis. Subscription fees are billed in advance on a recurring basis (monthly or annually, as selected). All fees are non-refundable except as required by law. You may cancel at any time; cancellations take effect at the end of the current billing period.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Resell, sublicense, or transfer your access to any third party without our written consent
  • Upload viruses, malware, or any other malicious code
  • Attempt to gain unauthorized access to other accounts, systems, or networks
  • Use the Service to send unsolicited communications or spam

6. Your Content

You retain all ownership rights to data, documents, images, and other content you upload or create using the Service (“Your Content”). You grant FieldWyre a limited, non-exclusive license to host, process, and display Your Content solely as necessary to provide the Service.

7. Intellectual Property

The Service, including its software, design, logos, and trademarks, is owned by FieldWyre and protected by intellectual property laws. These Terms do not grant you any rights to use our intellectual property except as expressly stated.

8. Third-Party Integrations

The Service may integrate with third-party platforms (QuickBooks, Stripe, Square, Twilio, etc.). Your use of those services is governed by their respective terms. We are not responsible for third-party services.

9. Termination

We may suspend or terminate your access to the Service at any time for violations of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ends immediately, and we may delete Your Content after a reasonable retention period.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIELDWYRE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify and hold FieldWyre harmless from any claims, damages, or expenses arising from your violation of these Terms or your misuse of the Service.

13. Governing Law

These Terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict of law principles. Disputes shall be resolved in the state or federal courts located in New Jersey.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated by email or through the Service. Continued use of the Service after changes constitutes acceptance of the revised Terms.
